James M. McCreedy

James M. McCreedy was born in Hackensack, New Jersey. He is a graduate of Christian Brothers Academy, Lincroft, New Jersey; the College of William and Mary; and the Dickinson School of Law, Penn State University. Jim was admitted to the Bars of the State of New Jersey and the State of Pennsylvania in 1991; the Federal Court for the District of New Jersey in 1991; the United States Court of Appeals for the Third Circuit in 1994, the United States Supreme Court in 2004, and the Federal Court for the Eastern District of Pennsylvania in 2021. He served as a law clerk for the Honorable Melvin P. Antell, P.J.A.D. during the 1991-1992 term.

Goldfarb, 295 N.J. Super. 212 (App. Div. 1996), rev’d, 154 N.J. 468 (1998) (ultimate outcome jury charge); Nead v. Union County Educational Services, 2010 WL 1768559 (affirming summary judgment in favor of school district in an employment case); L.F. v. Morris School District (2005 N.J. Admin.) (reimbursement for a unilateral placement case); M.B. o/b/o D.B. v. Morris School District, 2003 WL 21996077 (ALJ dismisses student’s special education unilateral placement petition following trial); S.B. v. Summit Board of Education 2013 WL 449490 (motion to dismiss granted where parents sued for breach of special education settlement); Lovett v. Flemington-Raritan Regional, 2013 WL 5925615 (affirming summary judgment in favor of District in an age discrimination case); Taffaro v. Borough of Ridgefield 2011 WL 1321657 (D.N.J.), 2013 WL 318659 (App. Div. N.J.) (affirming dismissal of false arrest litigation); Waters v. Emery 2008 WL 1820700 (App. Div. N.J.) (affirming no cause trial verdict in excessive force case); Kowaleski v. MUJC 2012 WL 1431381 (App. Div. N.J.) (affirming summary judgment in teacher on student assault case); Lawshe v. Squeri 2012 WL 276232 (D.N.J.) (granting summary judgment to defendant in $11 million franchise dispute); Hunsicker v. High Point Regional (2014 N.J. Admin.) (ALJ affirms dismissal of tenured athletic trainer whose license expired); Howell v. Greenwich Township, 2017WL6032522 (App. Div. N.J.) (collective bargaining agreement trumps contrary language in an employment manual regarding post employment benefits); J.F. v. Byram BOE, (Third Circuit Court of Appeals, May 14, 2020, No. 19-2412) (unilateral placement special education decision involving a transferred IEP).

Jim practices in a number of areas including school law; insurance defense; banking; employment discrimination and labor; collection; personal injury and medical malpractice; environmental; bankruptcy; and real estate. He has handled trial and appellate matters in the state and federal courts in New Jersey and Pennsylvania as well as the Office of Administrative Law. Consistent with our firm’s practice, Jim’s cases have taken him to municipal courts around the state, the OAL, the Chancery and Law Division of New Jersey Superior Court, Federal District Court, the Bankruptcy Court, the New Jersey Appellate Division, the New Jersey Supreme Court, the United States Court of Appeals for the Third Circuit and state and federal courts in Pennsylvania. Since its inception, Jim has been included on the Super Lawyers list by Super Lawyers magazine. Super Lawyers magazine is a business publication that conducts an annual survey of the State’s experienced attorneys.

Jim is currently serving on the School Law Committee. He is Chair of the Morris County Bar Association Employment Law Committee and has been a member of the District X Ethics Committee covering Morris and Sussex Counties. Jim is a member of the Morris County, New Jersey State and the American Bar Association. He participated in the Worrall F. Mountain Inn of Court. He serves on the Board of Directors for the Girl Scouts of Northern New Jersey and was a Cubmaster for many years. Jim also coached his children's teams in a number of different sports over the years.
